GIFT CERTIFICATE TERMS AND CONDITIONS

TERMS AND CONDITIONS:

1. Definitions:-

“redeem” means to reduce the value of the Gift Certificate down until the balance is nil by the selection of one or more items for sale by the Manly Antique Centre.

A reference to “we” “us” or “our” is a reference to Manly Antique Centre.

A reference to “you” or “your” is a reference to the person who has taken to agree to these terms and conditions under clause 1.2.

A reference to “recipient” is a reference to the person who was given the Gift Certificate from the purchaser.

A reference to “Gift Certificate” refers to an officially recorded gift certificate purchased from the Manly Antique Centre.

“expiry date” or “expiry period” means the date, being twelve (12) months from the recorded date of purchase, after which any remaining
funds on the Gift Certificate will not be available for redemption.

“cashed-in” refers to requesting cash money for the amount issued on the Gift Certificate instead of goods.

“date of purchase” refers to the date recorded in OUR records which should correspond with the date entered on the Gift Certificate but
if any discrepancy should arise OUR recorded date will be the one used to determine the twelve month’s expiry date.


2. AGREEING TO TERMS AND CONDITIONS

2.1 These terms and conditions apply to the Manly Antique Centre Gift Certificate.
2.2 You agree to be bound by these terms and conditions by purchasing or using the Gift Certificate.
2.2 By purchasing or using the Gift Certificate you warrant to us that you will comply with these terms and
condition and all applicable laws and that the Gift Certificate will not be used in any manner that is unlawful, misleading, deceptive, or otherwise harmful to others.
2.3 If you are giving the Gift Certificate to another person, you should ensure that he or she is aware of the terms and conditions of the Gift Certificate
and the relevant expiry date of the Gift Certificate (see clause 3.4) and that proof of identity upon redemption (see clause 4.1) is required
2.4 Gift Certificates cannot be cashed-in under ANY circumstances – there will be NO exceptions.


3. PURCHASING GIFT CERTIFICATES

3.1 Our Gift Certificates can be purchased on line through our website or over the counter at the
Manly Antique Centre – 259 Condamine Street, Manly Vale, NSW 2093
3.2 Our Gift Certificates have a minimum value of $25.00
3.3 At time of purchase we will request identification details of both the purchaser and the recipient of said Gift Certificate to help
guard against fraudulent use thereof.
3.4 Our Gift Certificates have an expiry date of exactly 12 months after the date of purchase – the date having being recorded separately at time of
purchase on both the Gift Certificate and in our own records.
3.5 If you are giving the Gift Certificate to another person you should ensure that he or she is aware of the terms and conditions that apply
to the Gift Certificate and that the Gift Certificate has an expiry date (as detailed in point 2.3).


4. REDEEMING YOUR GIFT CERTIFICATE

4.1 Proof of identity must be provided at time of redemption to staff at Manly Antique Centre
4.2 The Gift Certificate can only be redeemed at the Manly Antique Centre, 259 Condamine Street, Manly Vale, NSW, 2093.
4.3 The Gift Certificate has an expiry date of exactly 12 months from date of purchase. Any unused value of the Gift Certificate must be
used before the 12 month expiry period. Any remaining amount is NULL and VOID after this date.
4.4 When the Gift Certificate has expired it can no longer be redeemed or used.
4.5 Gift certificates cannot be refunded or cashed-in under any circumstances – NO EXCEPTIONS.
4.6 If the full value of the Gift Certificate is not completely used on initial redemption Manly Antique Centre will issue a separate Credit Note
for the remaining amount. This balance must also be redeemed within the 12 months expiry period from date of original purchase.
4.7 Where the price of the goods redeemed exceed the value of the Gift Certificate you must pay the excess amount by one of the accepted
payment methods currently used by the Manly Antique Centre. (see Payment Methods on this website)


5. LOST OR STOLEN GIFT CERTIFICATES

5.1 Your Gift Certificate must be treated as CASH. If you lose or damage your Gift Certificate or you think it may have been stolen you must contact
Manly Antique Centre immediately by phone <(02) 9949 7392 or 0402577272> or email us to avoid fraudulent use of your Gift Certificate by
other persons. We cannot be held responsible for fraudulent use of a Gift Certificate if prior notification has not been given to us of it’s loss by the recipient.
5.2 If the Gift Certificate is lost or stolen a credit note will be issued to the recipient after proof of identity has been established to our satisfaction.


6. LIABILITY

6.1 The purchaser and recipient are responsible for the Gift Certificate and are liable for all transactions made against the Gift Certificate.
6.2 Manly Antique Centre will endeavour to ensure the recorded recipient uses the Gift Certificate by demanding proof of identity at time of redemption
but if it is lost or stolen and we are not notified prior to its fraudulent use we cannot be held responsible.
